يثير موضوع مسئولية الطبيب الكثير من التساؤلات ولا سيما في العصر ‏الحالي مع التطور الطبي وما يصاحبه من أخطاء من ناحية والوعي القانوني للأفراد ‏من جهة أخرى . و لا شك أن المسئولية الطبية ليست وليدة العصور المتأخرة من ‏تاريخنا البشري، بل أنها قديمة تضرب جذورها في أعماق التاريخ‏ الأنساني .

والله انا الموضع عاجبنى جدا بس عندى نقد بسيط
مامعنى ان يكون الخطأ غير عمدى
فالخطا دائما غير عمدى وانما يلحقه اوصافا اخرى مثل جسيم وبسيط
لانه ان كان هناك خطأ غير عمدى لامكننا القول ان هناك خطأ عمدى فمتى تكون الجريمة عمدية اذا
